This Determination relates to the Clearance Application (“Application”) submitted by Newmont Corporation (“Newmont” or the “Applicant”) to the Independent Consumer and Competition Commission (“ICCC”) for the proposed acquisition of all the interests of Newcrest Mining Limited (“Newcrest”) in PNG (“Proposed Acquisition”). Newcrest has interests in PNG through its subsidiaries, Lihir Gold Mine Limited, Newcrest PNG 2 Limited, Newcrest PNG 3 Limited, and Newcrest PNG Exploration Limited (all referred as Newcrest in this Determination).
