PUBLIC NOTICE: PNG PORTS REGULATORY CONTRACT REVIEW – REVISED DRAFT REGULATORY CONTRACT AND REVISED DRAFT REPORT

The Independent Consumer and Competition Commission (‘ICCC’) would like to inform relevant stakeholders and the general public of the formal release of the revised Draft  Final PNG Ports Regulatory Contract and Report.

The current five-year Regulatory Contract between the ICCC and PNG Ports, which was previously extended, is set to conclude on 31^st December 2025. As a result, a comprehensive review is being conducted to establish a new Regulatory Contract covering the period from 2026 to 2030.

After publishing the Issues Paper and the initial Draft Report for the PNG Ports Regulatory Contract Review on 31^st March 2024 and 1^st July 2024 respectively, several complex matters emerged that required further examination and validation. In response, the ICCC has thoroughly evaluated feedback from key stakeholders and undertaken its own independent analysis, leading to the development of a revised Draft Final Regulatory Contract along with an updated review report.

The revised Draft Final Regulatory Contract and the Review Report are now being released for all stakeholders to review and provide their comments and views. There will be a month’s public consultation period allowed for all stakeholders.

The comments received on the revised Draft Final Regulatory Contract will assist the ICCC to establish new PNG Ports Regulatory Contract for the next five (5) year regulatory period (2026-2030).

All submission or comments should be forwarded to the ICCC no later than 17^th October 2024. Late submissions will not be considered.

Copies of the Revised Draft Report and Contract can be obtained from the ICCC’s website (www.iccc.gov.pg) or collected from the ICCC’s Head Office at 2^nd Floor Post Office Building, Boroko.
